The short version
- ATTO uses YouTube API Services. By using ATTO you agree to be bound by the YouTube Terms of Service.
- Your uploads and the packages we make for you are yours. Other creators' YouTube content is theirs, so study it but don't download or reuse it.
- Only upload photos of people who have agreed to it, and content you have the rights to.
- ATTO scores are estimates, not YouTube data and not guarantees.
- Paid plans renew until you cancel. Payments are non-refundable unless the law says otherwise.
The agreement
These Terms are an agreement between you and [FOUNDER: confirm legal operator name and any DBA] (“ATTO”, “we”, “us”). They cover ATTO's thumbnail and packaging tools at packager.tryatto.com: the thumbnail gallery and search, collections, the workspace, the shelf test on /compare, Pro analysis, and the Packager (together, “ATTO” or the “service”). ATTO Live has its own terms at tryatto.com/terms.
By creating an account or using ATTO, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use ATTO.
YouTube API Services
ATTO uses YouTube API Services to find and show public YouTube videos. By using ATTO, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Google's handling of data is covered by the Google Privacy Policy.
ATTO is an independent product. It isn't made, endorsed or sponsored by YouTube or Google.
Videos, thumbnails, titles and channel details from YouTube belong to their creators and to YouTube. ATTO shows them so you can study what works. You may not use ATTO to download, copy, scrape, store or redistribute other creators' content or YouTube data, or to pass off their work as yours.
Who can use ATTO
- You must be at least 13, or the minimum age in your country if that's higher. If you're under the age of majority where you live, a parent or guardian must agree to these Terms for you.
- Give accurate account details, keep your sign-in secure, and tell us if you think someone else has accessed your account. You're responsible for what happens under your account.
- An account is for one person. Don't share it or sell access to it.
Using ATTO for a business or for clients
If you use ATTO for a company, agency or clients, you accept these Terms on their behalf and confirm you're allowed to. You're responsible for having your clients' permission for every channel, clip, photo, logo and brand asset you submit. Team, agency and enterprise plans may come with a separate written agreement. Where it conflicts with these Terms, the written agreement wins for that plan.
ATTO estimates aren't guarantees
Scores, outlier multipliers, predicted performance, packaging scores and benchmarks are ATTO's own estimates, not YouTube data. They help you decide what to test and don't promise views, clicks, subscribers or revenue. Results on YouTube depend on many things we don't control.
Plans, billing and fair use
Free and Pro
ATTO has a free plan with limits, and paid Pro plans. Current prices and what each plan includes are shown in the app and at checkout. Stripe processes payments. Prices may not include taxes, which we add where the law requires.
Automatic renewal and cancelling
Monthly and annual Pro plans renew automatically at the end of each billing period until you cancel. Cancel any time with Manage subscription on the Pricing tab, which opens Stripe's billing portal. Cancelling stops the next charge, and you keep Pro until the end of the period you've paid for. If we change a price, we'll tell you before it applies to your next renewal.
Lifetime
Pro Lifetime is a one-time payment for Pro for as long as ATTO offers these tools. That means the life of the product, not your lifetime. It's personal to your account and can't be transferred. If we ever shut the tools down, we'll give you reasonable notice first.
Refunds
Payments are non-refundable, except where the law requires a refund.
Fair use
Plans are for normal use by one person. Anything described as “unlimited” is still subject to fair use. We may set reasonable limits, such as searches per day, to keep ATTO fast for everyone and within the limits of the services we depend on, including YouTube API Services.
Downloads of your packages
Free includes 720p downloads and Pro includes downloads up to 4K of your own Packager results: the thumbnails ATTO generates and upscales for you. ATTO doesn't offer downloads of other creators' YouTube thumbnails.
Your content and what ATTO makes for you
You own your content
“Your content” means what you put into ATTO: descriptions, titles, links, clips, thumbnails, and face and reference photos. You keep all your rights in it. You give ATTO a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display your content only to run ATTO for you. That includes sending it to the service providers listed in our Privacy Policy. The license ends when you delete the content or your account, except for copies the law requires us to keep.
We don't use your content to train ATTO's models.
Outputs
The titles and thumbnails ATTO generates for you (“outputs”) are yours to use on your own channels or your clients' channels. To the extent we have any rights in them, we assign those rights to you. Outputs are made with AI, so:
- they can be wrong, odd or unsuitable, so review them before you publish;
- other users may receive similar outputs, which aren't exclusive to you;
- we can't promise they're protected by copyright or free of other people's rights, especially where your inputs include someone else's material.
When you publish anything made with ATTO, you're responsible for following YouTube's Terms and Community Guidelines, including its rules against misleading titles and thumbnails.
Photos of people, and the rights you need
Only submit content you have the right to use. In particular:
- Upload photos of yourself, or of people who have agreed to be in your thumbnails. For anyone under 18, you need a parent's or guardian's permission.
- Only submit clips, logos, products and brand assets that you own or have permission to use.
- Don't use ATTO to put real people in sexual, degrading, defamatory or misleading images, or to impersonate anyone.
ATTO uses face photos only to make your thumbnails. It measures light and exposure, and never identifies people or labels their skin tone, race, age or gender. See the Privacy Policy.
Acceptable use
Don't use ATTO to:
- break the law or infringe anyone's rights, including copyright, trademark, privacy and publicity rights;
- create any sexual content involving minors, or any content that exploits children;
- scrape, crawl, bulk-download or harvest data from ATTO, or extract, store or redistribute YouTube data through it;
- resell, sublicense or share access to ATTO or the data it shows, unless you have a written agreement with us;
- get around limits, for example by making extra free accounts or automating requests;
- use ATTO or its data to build a competing dataset or service, or to train AI models;
- probe, attack, overload, reverse engineer or disrupt ATTO, or upload malware.
Copyright complaints
If you think something in ATTO infringes your copyright, email [FOUNDER: supply a verified support contact email] with: the work you own, where it appears in ATTO, your contact details, a statement that you believe in good faith the use isn't authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner. We remove infringing material and close the accounts of repeat infringers. For content hosted on YouTube, please also use YouTube's own copyright tools.
Other services
ATTO depends on services run by others, including YouTube, Google, Stripe, OpenAI and Anthropic. Their terms apply when you use them, for example Stripe's when you pay. We aren't responsible for those services, and if one of them changes or limits what it offers (for example YouTube API access), some ATTO features may change or stop.
Changes and availability
We're improving ATTO all the time, so features may change, and some may be added or removed. We try to keep ATTO available but can't promise it will always be uninterrupted or error-free. Keep your own copies of results you care about.
Suspension, termination and deleting your account
You can stop using ATTO at any time, and delete your account from the Account menu → Delete my account. We complete deletion within 7 days, as described in the Privacy Policy. Deleting your ATTO account doesn't affect your YouTube or Google account. Cancel any paid subscription too, if deletion hasn't already cancelled it.
We may suspend or close your account if you break these Terms, if the law, YouTube or another provider requires it, or if we need to protect ATTO or its users. Where we reasonably can, we'll tell you first and give you a chance to fix the problem. Some things we have to act on immediately, such as illegal content or security incidents.
Sections that by their nature should continue after your account ends will continue, including those on your content, disclaimers, liability, indemnity and disputes.
Disclaimers
ATTO is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't warrant that estimates or outputs are accurate, or that ATTO will meet your goals.
Limitation of liability
To the fullest extent the law allows, ATTO won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, views or data. Our total liability for any claim about ATTO is limited to the amount you paid us in the three months before the claim. Some places don't allow these limits, so they may not all apply to you.
Indemnity
If someone brings a claim against ATTO because of your content, or because you used ATTO in breach of these Terms or the law, you'll cover ATTO's reasonable losses and costs from that claim, as far as the law allows.
Governing law and disputes
If you have a problem with ATTO, email [FOUNDER: supply a verified support contact email] first. We'll try to resolve it informally within 30 days before either of us starts a formal proceeding.
These Terms are governed by [FOUNDER: confirm governing law with counsel], and disputes will be heard in [FOUNDER: confirm courts with counsel]. Nothing in these Terms takes away consumer protection rights you have where you live.
Changes to these Terms
When we update these Terms we'll change the effective date at the top. If a change is significant, we'll tell you in ATTO or by email before it takes effect. If you keep using ATTO after that, you accept the updated Terms. If you don't agree, stop using ATTO and delete your account.
